Call of Duty: Finest Hour Developer Sues Activision

Spark Unlimited accuses Activision of breach of contract, claims $10 million in damages.

Spark Unlimited, the developer of Call of Duty: Finest Hour for console systems, has filed a lawsuit against publisher Activision for $10 million in damages. Spark is accusing Activision of breach of contract and stealing franchise ideas, among numerous other things.

Spark claims that it signed a minimum three-title agreement to develop the Call of Duty series with Activision, and that the publishing giant took steps to deter Spark from staying on the project after the release of Finest Hour. Grey Matter and Spider-Man 2 developer Treyarch were brought in to replace Spark for the console sequel, Call of Duty 2: Big Red One.

Spark contends that to discourage it off the project, Activision forced the developer to accept lower royalties before attempting to kill Spark off entirely.
