It haunts your dreams. And now it haunts Microsoft's, too.

The Xbox 360 Red Ring of Death, hereby known as the RROD, has reared its ugly red head again today, this time in the form of a class action lawsuit filed by disgruntled consumers in California.

The lawsuit alleges that an excessive number of Xbox 360 consoles have experienced hardware failures, aka the RROD. Perhaps more damning is the lawsuit's allegation that Microsoft knowingly manufactured faulty Xbox 360 consoles, and then concealed the failure rate in order to better compete with The PlayStation 3 and Wii.

As evidence, the lawsuit presents articles from a variety of gaming publications, including dailygamesnews.com, VentureBeat, Digital Media and Yahoo! Each of these articles states that Microsoft knew as far back as November 2005 that over 50% of Xbox 360 consoles were defective (emphasis added because that's an insane number in an industry where 3% or so is the accepted norm).

Lastly, the lawsuit seeks a court order that would force Microsoft to pay off the disenfranchised Xbox 360 owners with all profits that it made from sale of the console. A kind of RROD refund program, if you will.

I love my Xbox 360, and mine personally has never Red ringed (although i did have one scratched disc). But it would be sweet to receive a refund. Although it was respectable that they extended the warranty to 3 years, IMO they really should have recalled the system.

Win or lose the case this is bad for the image of Microsoft as a console maker.
Hopefully after this they put the console failure issues behind them.

not sure they'll make a difference, but if they were to succeed... MS will have to delay the new console just to pay off debts... but i dont forsee this happening.

Ah, stupid idiots always trying to sue over stupid little things just to gain financially. If a machine fails, MS replaces it. That's good enough. These idiots only want attention. If they knew the system had a high failure rate, they shouldn't have bought one. But they did, and now they think they can sue over it. Go to hell.

I've honestly have been though 5 and now I'm on my 6 one. Even though MS customer service is great and they always sent me a replacement I think MS shot themselves in the foot with the RROD. I never been a Sony fan but after all this trouble I've had with the 360
when the next systems come out I will consider buying the next Playstation before I consider buying MS next system.
